These Terms & Conditions (“Terms”) govern your use of this website and your purchases from the online shop operated by Wandalands Vineyard and Orchards, LLC (“Wandalands,” “we,” “us”), 113 Barnes Road, Jackson, Georgia 30233. By using the site or placing an order you agree to these Terms, our Privacy Policy, and our Shipping & Returns policy. If you do not agree, please do not use the site.
Using this website
You may use the site for lawful, personal purposes. You agree not to interfere with its operation, attempt to gain unauthorized access to any part of it, scrape or copy its content in bulk, submit false information, or post reviews or messages that are abusive, misleading, or infringe someone else’s rights. We may remove content or restrict access at our discretion.
Accounts
You can shop as a guest or create an account at checkout. If you create one, you are responsible for keeping your password confidential and for activity under your account. Tell us promptly if you believe your account has been used without your permission.
Online orders
Products and pricing
We sell farm-grown and farm-made products: pecans, gift boxes, pantry goods such as jams, preserves, chow chow, sauces, and pickles, and, in season, fresh fruit. Because these are agricultural products, availability depends on the harvest and the weather. Product photos are representative; natural variation in size, color, and appearance is normal. Prices are in U.S. dollars and may change without notice, but the price shown when you place your order is the price you pay. Shipping is charged separately as shown at checkout.
Placing an order
Your order is an offer to buy. We accept it when we send your shipping confirmation. We may decline or cancel an order at any time before shipment, for example if a product is unavailable, a price or description was listed in error, or we suspect fraud. If we cancel a paid order, we refund it in full to the original payment method.
Payment
We accept major credit and debit cards, Apple Pay, and Google Pay. Payment is taken when you place the order. You confirm that you are authorized to use the payment method you provide.
Shipping, returns, and refunds
We currently ship within the United States only. Delivery times, our policy on damaged or incorrect orders, and refund terms are set out in Shipping & Returns, which forms part of these Terms.
Food products and allergens
Our products contain or are produced alongside tree nuts (pecans and others) and may contain other allergens. Read the label on each product before eating it. If you have a food allergy and need ingredient details before ordering, contact us first.
Visiting the farm
Wandalands is a working farm with orchards, a vineyard, a pond, uneven ground, farm equipment, and animals and insects that live outdoors. By visiting you accept the ordinary risks of being on agricultural land and agree to follow posted signs and staff instructions, supervise children in your care at all times, stay out of areas marked off-limits, and leave plants, fruit, and equipment alone unless you are taking part in a U-pick or tour. Events
Each event listed on our Events page states its own date, admission, and what is included; that listing is the source of truth for the event. Events may be postponed or canceled because of weather or other circumstances beyond our control. Where an event uses a third-party ticketing service, that service’s terms apply to your ticket, and any refund for a canceled paid event is handled through the service you bought it from.
Photographs and video are sometimes taken at public events for use on our website and social media. If you do not want to appear in them, let a staff member know at the event.
Venue rental, photography and film, and consulting
Private venue rentals, photography and film location use, and land consulting are arranged by inquiry and are governed by a separate written agreement between you and Wandalands. Submitting an inquiry through this site does not create a booking or reservation. Nothing on the site is a commitment to availability, and the terms of the signed agreement control if they differ from these Terms.
Reviews and submissions
If you post a product review or send us photos, comments, or other content, you give us a non-exclusive, royalty-free, perpetual license to use, reproduce, and display it in connection with our business, including on this site and social media, with or without your name. You confirm that the content is yours to share and does not infringe anyone else’s rights. We may edit or remove submissions at our discretion.
Intellectual property
The Wandalands name and logo, and the text, photographs, and design of this site, belong to Wandalands Vineyard and Orchards, LLC or are used with permission. You may view and print pages for personal, non-commercial use. Any other use, including reproducing our photographs or copy, requires our written permission.
Third-party links
The site links to third-party services such as maps, ticketing, and social media. We are not responsible for their content or practices, and linking to them is not an endorsement.
Disclaimer and limitation of liability
The site and its content are provided “as is.” We try to keep information accurate and current, but we do not guarantee that descriptions, availability, hours, or other content are error-free, and we may correct errors without notice. To the fullest extent permitted by law, Wandalands Vineyard and Orchards, LLC, its owners, and its staff are not liable for indirect, incidental, or consequential damages arising from your use of the site or your purchases, and our total liability for any order is limited to the amount you paid for that order. Nothing in these Terms limits liability that cannot be limited under applicable law, including for personal injury caused by our negligence.
Governing law
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts serving Butts County, Georgia, and you consent to their jurisdiction.
Changes to these Terms
We may revise these Terms from time to time. The effective date at the top shows the current version. Changes apply to orders placed and site use after they are posted.
